These Terms of Service ("Terms") constitute a legally binding agreement between you and Pawsitive Training LLC ("Company," "we," "us," or "our"), regarding your access to and use of the DingerAI Baseball mobile application (the "App") and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. You represent and warrant that you meet these eligibility requirements.
To access certain features, you must create an account. You agree to: (a) provide accurate and complete information during registration; (b) maintain the security of your account credentials; (c) promptly update your information if it changes; and (d) accept responsibility for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
The Service is offered on a subscription basis through the Apple App Store. Current subscription tiers include Pro ($14.99/month or $69.99/year) and Recruit ($24.99/month or $199.00/year). Prices may change at our discretion with notice through the App.
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription through your Apple ID account settings. No partial refunds will be provided for unused portions of a subscription period, except where required by law.
Apple's Standard End User License Agreement also governs your subscription. Apple is not a party to these Terms but is a third-party beneficiary with respect to subscription-related provisions.
The Service uses artificial intelligence, including Google's Gemini API, to analyze uploaded videos of baseball swings and pitching deliveries and generate coaching feedback, scores, drills, and recommendations ("AI Analysis"). You acknowledge and agree that:
(a) AI Analysis is provided for informational and educational purposes only and should not be relied upon as professional coaching, medical advice, physical therapy, or biomechanical evaluation;
(b) AI Analysis may contain inaccuracies, errors, or limitations and may not reflect actual performance or technique quality;
(c) You should consult qualified human coaches, trainers, and medical professionals for personalized guidance, especially regarding injury prevention or competitive preparation;
(d) We make no warranties regarding the accuracy, completeness, or reliability of AI Analysis;
(e) You are solely responsible for how you apply AI Analysis to your training, and we are not liable for any outcomes resulting from your use of or reliance on it.
The Recruit tier includes access to contact information for college baseball coaches and tools for outreach. You acknowledge and agree that:
(a) Coach contact information is compiled from publicly available sources and is provided for your personal, non-commercial use only;
(b) You will not share, resell, redistribute, or use coach contact information for any purpose other than your personal outreach regarding your own recruitment;
(c) You will comply with all applicable laws, including anti-spam laws (CAN-SPAM Act), when contacting coaches;
(d) We make no guarantees about the accuracy or currentness of coach contact information, coach responsiveness, or your recruitment outcomes;
(e) You are solely responsible for the content of all communications you send through the Service.
Misuse of coach contact information, including spam, harassment, or commercial use, will result in immediate account termination.
You retain ownership of videos, game logs, messages, and other content you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use your User Content as necessary to provide and improve the Service, including processing videos through third-party AI services.
You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not violate any law or third-party rights; and (c) your User Content does not contain images or recordings of minors without parental consent.
We reserve the right to remove User Content that violates these Terms or is otherwise objectionable.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse engineer, decompile, or extract source code from the App; (c) interfere with or disrupt the Service; (d) attempt unauthorized access to accounts or systems; (e) use automated means to access the Service (bots, scrapers, etc.); (f) upload malicious code or harmful content; (g) impersonate others or misrepresent your affiliation; (h) harass, threaten, or abuse other users or coaches; (i) upload content depicting minors in inappropriate contexts; or (j) resell, sublicense, or commercially exploit the Service.
The Service, including all software, designs, logos, text, graphics, and content (excluding User Content), is owned by Pawsitive Training LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, OR PRODUCE ANY SPECIFIC RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWSITIVE TRAINING LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100.
You agree to indemnify and hold harmless Pawsitive Training LLC, its officers, employees, agents, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; (d) your violation of any law or third-party right; or (e) your communications with coaches or other third parties through the Service.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may terminate your account at any time by using the Delete Account feature in the App or by emailing kevin@pawsitivetraining.org. Upon termination, your right to use the Service ends, but provisions that by their nature should survive (including ownership, disclaimers, liability limits, and dispute resolution) will survive.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email at least 7 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Henrico County, Virginia, and you consent to the personal jurisdiction of those courts.
You acknowledge that these Terms are between you and Pawsitive Training LLC, not Apple Inc. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price; beyond that, Apple has no other warranty obligations. Apple is not responsible for addressing any claims relating to the App or your use of it. Apple is a third-party beneficiary of these Terms and may enforce them against you.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right does not waive that right. You may not assign these Terms; we may assign them without restriction.
